I. Application, Scope
These General Terms and Conditions (hereinafter referred to as "GTC") apply to all deliveries and services provided by X-Technology Swiss R&D AG, Flurstrasse 55, 8048 Zurich, Switzerland.
Deviating or supplementary general terms and conditions of the customer do not apply unless expressly agreed upon in writing.
II. Conclusion of Contract, Contract Language
The presentation of products in our shop does not constitute a legally binding offer but a non-binding online catalog.
By placing an order (clicking "Order Payable"), you submit a binding purchase offer.
Receipt of the order is confirmed via email, along with our GTC and revocation instructions. This does not constitute acceptance of the order.
The contract is concluded when we confirm the dispatch of the order via email or deliver the goods.
If you pay via PayPal, the contract is concluded upon order submission.
The contract language is English.
III. Prices, Payment Methods
All prices are listed in the country's respective currency and include VAT, exceptions may apply.
Import duties may apply for non-EU countries.
Accepted payment methods are communicated during the checkout process.
IV. Order Cancellation Policy
1. Our Right to Cancel Orders
We reserve the right to cancel any order at our discretion, this right does not apply once the contract has been concluded, unless permitted by mandatory consumer protection law,
including but not limited to the following situations:
Stock unavailability: The product is out of stock or discontinued.
Pricing errors: Incorrect prices or product descriptions due to system errors.
Fraud prevention: Orders flagged as fraudulent or failing security checks.
Legal restrictions: Customs or trade laws prohibit shipment.
Payment issues: Payment authorization fails or is flagged as suspicious.
Operational disruptions: Unforeseen circumstances, such as force majeure, supply chain delays, or logistics failures.
Misuse of discounts, coupons, or promotions: If an order was placed using a leaked, unauthorized, or improperly applied discount code, or any manipulative pricing method resulting in an unfair transaction, we reserve the right to cancel the order without liability.
If we cancel your order, we will notify you immediately via email. Any payments made will be refunded in full within 5-10 business days, unless fraud or policy violations apply.
2. Customer-Initiated Cancellations
Orders may be canceled before shipment by contacting customer service.
Once an order enters fulfillment, cancellation is no longer possible.
If an order has already shipped, our return and refund policy applies.
3. Refund Processing
Refunds for canceled orders are processed within 5-10 business days.
If an order is canceled before shipment, a full refund will be issued.
If canceled after shipment, the return policy applies.
Orders canceled due to fraud, misuse of discount codes, or unauthorized payment methods may be withheld only where permitted by mandatory Swiss or EU consumer law.
V. Return Costs & Policy
Returns must be made within 60 days of receipt.
Customers must use the pre-printed return slip for all returns.
Return shipping costs are deducted from refunds.
Exceptions: Returns will not be accepted if:
The return period (60 days) has expired.
The item has visible signs of wear, stains, or odors.
The original packaging is damaged or missing.
The item is returned without tags or labels.
For returns with signs of wear, 20% of the item’s price may be deducted from the refund.
VI. Delivery Costs & Times
Delivery costs are displayed at checkout.
Estimated shipping times are shown during the ordering process.
VII. Lost Parcels Policy
1. Notifying Us of a Lost Parcel
If you have not received your parcel within the expected delivery timeframe, you must notify us within a reasonable period, at least 7 days of the estimated delivery date to initiate a claim.
2. Seller Responsibility & Investigations
If your parcel required a signature upon delivery, we will investigate the issue with the courier. If the parcel is confirmed lost, we will issue a refund or replacement within 14 business days.
If your parcel was delivered without a signature (e.g., left at your doorstep or mailbox), we will verify delivery status via tracking and courier confirmation.
3. Customer Responsibility for No-Signature Deliveries
If you selected “No Signature Required” or authorized the courier to leave the package at your address, you assume full responsibility for any loss or theft after delivery is marked as completed.
To proceed with a claim in such cases, you must provide supporting evidence (e.g., security camera footage, witness statements, or police reports).
4. Proof of Delivery Requirements
If a dispute arises regarding delivery, we require:
Tracking confirmation from the courier.
Signature confirmation (if applicable).
Photo evidence of delivery (if available).
If we cannot verify delivery, we will issue a refund or replacement.
5. Claim Processing Timeline
Investigations into lost parcels take up to 14 business days.
If the claim is approved, we will process a refund or replacement within 5-10 business days.
VIII. Storage of Contract Data
Your personal and contract data (name, address, order details, etc.) are stored in accordance with statutory retention periods under Swiss law, GDPR, and accounting regulations after the contract's conclusion. IX. Retention of Title
Ownership of goods remains with X-Technology Swiss R&D AG until full payment is rexceived.
X. Warranty & Liability
You are entitled to statutory warranty claims.
We exclude liability except for:
Fraudulent misrepresentation.
Breach of essential obligations (cardinal duties).
Gross negligence, intent, or injury to life/body/health.
Product liability claims under applicable law.
Warranty covers:
Manufacturing defects (stitching, zippers, material flaws).
Performance faults (e.g., sole separation in running shoes).
Warranty does not cover:
Normal wear and tear.
Improper care (failure to follow washing instructions).
Accidental damage or modifications.
XI. Dispute Resolution (EU & Swiss Consumers)
EU Customers: The European Commission provides a platform for online dispute resolution (www.ec.europa.eu/consumers/odr).
Swiss Customers: Legal disputes are handled under Swiss Obligationenrecht (OR) and UWG (Unfair Competition Act).
XII. Place of Jurisdiction & Applicable Law
For EU consumers, the law of the consumer’s habitual residence applies. German law applies only insofar as it does not deprive consumers of mandatory protections.
For Swiss customers, Swiss law (Obligationenrecht OR, UWG) applies.
For international customers, local consumer protection laws may provide additional rights.
